You have just signed the Offer to Purchase on your dream property and received confirmation that the Seller has accepted – YAY! But before you can even celebrate you are asked by the estate agent for FICA documents and to fill in a questionnaire. Next up, you pay your deposit to the conveyancers who almost immediately request FICA again and hit you with a different questionnaire. Then, you’re off to apply for bond approval and here we go again: the Originators and Banks are asking for all the same things and more! Why do you need to provide all this to each institution?

Understanding FICA and Its Importance

FICA, or the Financial Intelligence Centre Act, was enacted in 2001 to combat financial crime in South Africa. This act plays a crucial role in addressing South Africa’s current grey-listed status by providing the legal framework needed to fight money laundering and terrorist financing. Strong compliance with FICA is vital for demonstrating to international organisations, such as the Financial Action Task Force (FATF), that South Africa is effectively tackling financial crime risks. This commitment is essential for avoiding grey-listing and can help South Africa to be removed from the grey-list by showcasing our dedication to fighting these crimes.

What Is Grey-listing?

Grey-listing occurs when the FATF publicly identifies a country as having shortcomings in its anti-money laundering and counter-terrorism financing regulations. While South Africa is actively working to improve its systems, existing deficiencies can lead to increased scrutiny and complications, particularly with international financial transactions.

How Does Grey-listing Impact You?

• Increased Checks: Financial institutions may impose extra checks and procedures for transactions involving individuals or businesses from grey-listed countries, which can result in delays and more documentation requirements.

• Economic Effects: Grey-listing can hinder our country’s economy by making it challenging to attract foreign investment, leading to higher costs for international transactions.

What Can We Do to Be Removed from the Grey-list?

To be removed from the grey-list, it is essential for South Africa to comply with FICA and demonstrate significant progress in addressing the identified shortcomings.

How to Improve Your FICA Compliance

For Accountable Institutions:

• Register with the FIC.

• Appoint a dedicated compliance officer.

• Develop a robust Risk Management and Compliance Program (RMCP).

• Conduct thorough customer due diligence.

• Implement regular training for employees on FICA regulations.

• Report any suspicious activity to the FIC promptly.

For Individuals:

• Keep your FICA documents organised and updated for easy access when requested by accountable institutions.

• If connected to a Trust or juristic entity, create an organogram to clearly  show the entity’s structure and identify the ultimate beneficial owner/s.
