SELLERS, REMEMBER TO SPECIFY WHAT YOU INTEND TO TAKE WITH YOU WHEN YOU SELL YOUR PROPERTY

By default, the sale of immovable property includes everything fixed and fitted to the property that is sold. So if you were to visualize the sale of your property as the sale of a dolls house, everything that would remain after you pick it up, turn it over and shake it – is sold!

It is therefore of vital importance that you tell your estate agent early in the marketing process whether you intend to take anything fixed or fitted to the property with you once a sale is concluded. Any fixtures or fittings to be excluded must be specifically recorded in the sale agreement – if you neglect to do so you may well find that you’ve unwittingly sold an heirloom that has been with the family for generations!
