WHY CAN’T I JUST SIGN MY TRANSFER DOCUMENTS ABROAD?

The reality is, a wet ink signature is always required for property transactions in South Africa, and if you sign your transfer documents outside of the country, that signature must be properly authenticated to be accepted by the relevant authorities within South Africa. 

What does authentication mean?

It’s a process that verifies your signature and ensures the documents are legally valid for use within South Africa. The method applicable will depend on where you sign:

– High Court Rule 63:  

If you’re signing in a foreign country, the document needs to be signed in the presence of a designated official—such as a head of a South African diplomatic or consular mission—and authenticated with an official seal or certificate.

– Hague Convention (Apostille): 

Countries that are members of this international treaty allow documents signed before a Notary Public to be Apostilled—officially certified by a government authority—making them valid for use in South Africa.

– Notary Public Attestation:  

 In certain countries like the UK, Zimbabwe, Botswana, Lesotho, and Swaziland, a Notary Public can sign and seal the document, providing the necessary authentication without the appending of an Apostille.

Failing to properly authenticate transfer documents signed abroad can cause delays in transferring ownership of your property. If you know that you will be travelling abroad, it is a good idea to sign a Special Power of Attorney — a legal document signed before you leave that authorises someone else to sign on your behalf, thus eliminating the need to sign abroad.

Remember that this guidance refers to the transfer documents required by your Conveyancer, not the Sale Agreement. A Sale Agreement can be validly signed abroad by means of a “wet ink” signature, and then scanned and emailed back to South Africa
